The Superior Prosecutor of Catalonia has presented a complaint for disobedience against the president of the Generalitat, Quim Torra, which he accuses of ignoring the order of the Central Electoral Board to withdraw the yellow ties and banners in support of the politicians imprisoned in the buildings of the Generalitat.

The complaint maintains that Torra “repeatedly” neglected the orders of the Electoral Board when he maintained the “partisan” symbolism, which in the opinion of the Prosecutor’s Office is “especially serious insofar as it directly affects the right to political participation of all citizens , which must be protected and preserved “.

The Prosecutor’s Office adds in its complaint, presented before the Superior Court of Justice of Catalonia (TSJC), that the Catalan president “consciously and deliberately” ignored the “clear and express” requirement issued by the Electoral Board.

According to the public ministry, the Catalan president, “even in a covert or symbolic way”, kept the “elements that are the object of the request” in buildings of the Generalitat, through “posters, images, figures, photographs and general symbols of the same ideological and partisan nature, representative only of the postulates of a part of society “.

Once the complaint is received, the TSJC has appointed magistrate Carlos Ramos – who has been assigned by distribution – as rapporteur for it, to study it before the admissions room decides whether to investigate it.

Complaint of the Generalitat against the Central Electoral Board

For its part, the Generalitat has announced that the Catalan president has formalized this Wednesday the complaint he announced last week against the Central Electoral Board (JEC) for the resolutions in which this body urged him to remove yellow ties from public buildings.

The complaint attributes to all the members of the JEC an alleged crime of prevarication and Torra warns that, if the Supreme Court rejects it, the Generalitat “will take the case as far as necessary if the Kingdom of Spain does not want to investigate the facts “.

In addition, Torra has criticized the complaint that the Superior Prosecutor of Catalonia has presented against him for not withdrawing yellow ties: “It is clear that the repression does not stop. The Spanish State is incapable of tolerating political disagreement.”

In a statement, the president has defended that he acted in this way with the ties to remain “firm in the defense of civil, social and national rights” and to vindicate freedom of expression, which he has considered to be one of the strongholds of democracy.

Torra has ensured that he does not renounce to defend himself in the judicial process, so he will exercise the right of defense and present the allegations and the pertinent resources “within the deadlines set by the judicial proceedings.”
