The Treatment Boards of the prisons of Lledoners (Barcelona), Puig de les Basses (Girona), and the Wad-Ras (Barcelona) have unanimously proposed the third degree penitentiary for the nine independence leaders condemned by the Supreme Court for promoting 1-O.
At a press conference, Amand Calderó, the Secretary of Criminal Measures, Reintegration and Attention to the Victim of the Department of Justice of the Generalitat, explained this Thursday the proposal agreed by the Treatment Boards, that The Department’s Classification Service must validate in two months.
The prisons had until next Thursday, July 9, to review second grade from the former vice president Oriol Junqueras, the ex-councilors Jordi Turull, Josep Rull, Quim Forn, Dolors Bassa Y Raül Romeva, the former Speaker of Parliament Carme Forcadell, the former president of the ANC Jordi Sànchez and the president of Òmnium Cultural, Jordi Cuixart, upon expiration of the six-month period stipulated in the Penitentiary Regulations to review the prison grade.
The treatment boards of the three prisons have met simultaneously at 09:00 this Thursday to review the grades – for “protect them from potential threats and coercion“in their decisions and report transparently and without interference, according to the secretary- and they have adopted the nine proposals for progress to third grade unanimously.
When the first classification was made, on December 11, the treatment boards had adopted the second degree proposal by majority, but not unanimously, since there was a “intense debate“, with an adjusted balance between second and third grade, Calderó explained.
Now, if the third degree is finally approved, the nine inmates will continue their sentence in semi-release regimeSo they will sleep in jail during the week, and the weekend can be spent at home.
Calderó has pointed out that with the proposed new classification a period of two months is opened in which the Classification Service must study the proposals and issue a resolution ratifying or not: if he ratifies it, they would immediately leave in an executive manner.
The proposals of the treatment boards are endorsed by the Classification Service in around 95% of cases, and normally the deadline for giving an answer is not exhausted. Once there is a resolution of the Classification Service, the Prosecutor’s Office may appeal before the prison surveillance court and subsequently to the sentencing court, in this case the Supreme Court.
He has also referred, to questions from journalists, if they can immediately apply the article 86.4 of the Penitentiary Regulations, which allows you not to spend the night in prison, and has pointed out that it depends on the treatment teams but that it is very difficult to apply it directly.
