To explain its decision, the high court specifies that Torra’s request, which had the endorsement of the Prosecutor’s Office, is supported by arguments “that refer mainly to the merits of the appeal, and must be addressed in the sentence handed down; furthermore, they are related to the criminal proceeding in which the appellant has been convicted and, therefore, in this measure is outside the contentious-administrative procedure “.

Furthermore, the arguments used in his appeal by the President of the Generalitat “do not allow us to appreciate, at this moment, the alleged unconstitutionality, nor to warn the appearance of good law in the claims of the appellant.”

The Supreme Court also establishes that the JEC agreement “does not create an irreversible situation”, and also that deciding the precautionary measure would mean depriving current legal provisions of effect.

The Prosecutor’s Office endorsed Torra’s request

Thus, the Administrative Litigation Chamber has rejected Torra’s request, which was also supported by the Prosecutor’s Office, to suspend the decision of the electoral referee while it studied the merits of the matter. The JEC adopted the agreement to withdraw the act from Torra after he was convicted by the Superior Court of Justice of Catalonia for not removing the yellow ties from public buildings during the electoral period, in a sentence that is not yet final.

The Prosecutor’s Office had submitted a report to the Supreme Court in which it supported the precautionary suspension of the agreement in which the JEC urged the withdrawal of Torra’s credential as a deputy, “in order to ensure the prudent and balanced” preservation “of the concurrent public interests.” .

In its brief, the Prosecutor’s Office questioned the competence of the JEC to order the dismissal of Quim Torra as a deputy, due to unexpected incompatibility given the “apparent viability” of the arguments of the President of the Generalitat and the dissenting members of the electoral referee.

The Chamber had already unanimously rejected the urgent (very precautionary) suspension of the JEC agreement, and had decided to process its request in the form of precautionary measures, that is, listening to the rest of the parties.

Torra insists that he is still a deputy and president

Once the decision of the Supreme Court is known, Quim Torra has insisted that he continues to be a deputy of the Parliament and president of the Generalitat: “We are not going to back down”He said, in an institutional statement in which he also assured that “there is no change with respect to January 3 and the decision that the plenary session approved the next day.”

Torra was referring to his appearance on January 3, in which he expressed himself in the same terms when the JEC’s opinion was known, and to the plenary session that was held on 4 at the request of the president who ratified him as a deputy and head of the Executive Catalan.

The president has also referred to the Bureau of Parliament also ratified it, considering that the JEC was not competent to disqualify him and that he had to wait for the Supreme Court. It did so based on a report from the Chamber’s lawyers, and, among others, with the endorsement of the PSC.

However, after this decision, the PSC is one of the groups that has requested, at the Board of Spokespersons held this Thursday, a new report to the lawyers, in case the decision of the Supreme Court modifies the position of the jurists regarding the status of deputy of Torra.

The Central Electoral Board demands that Torrent suspend Torra

For its part, the Central Electoral Board has requested this Thursday the president of the Parliament of Catalonia, Roger Torrent, to “Immediately” comply with your agreement of January 3 and strip the Catalan president, Quim Torra, of his status as a deputy for having disobeyed the electoral body.

In addition, the JEC urges Torrent to send him the documentation that “certifies” the loss of Torra’s “deputy status” in an agreement adopted after considering that his January decision is “fully executive” since the precautionary suspension that had Torrent’s own request “has been denied by the competent court”, that is, the Supreme Court.

To adopt this agreement, the Board has taken into account a request from Vox to the President of Parliament to comply with the suspension of Torra, as well as the allegations presented by Roger Torrent before the JEC and the Supreme Court order issued today in which establishes that “there is no place for the adoption of the precautionary measure of suspension of effectiveness” of the agreement of January 3.
